1. Definitions
In these Terms and Conditions:
- "Service" refers to the corporate property rental and accommodation management services provided by silvantada.
- "Tenant" means the individual or corporate entity renting a property through our services.
- "Property" refers to any residential accommodation managed and offered for rent by silvantada.
- "Agreement" means these Terms and Conditions together with any lease agreement or rental contract.
- "We," "Us," "Our" refers to silvantada, operating from 9 Jalan Perak, 50450 Kuala Lumpur, Malaysia.
2. Acceptance of Terms
By using our services, submitting inquiries, or entering into a rental agreement with silvantada, you confirm that:
- You have read and understood these Terms and Conditions
- You agree to be bound by these terms
- You are at least 18 years of age and have legal capacity to enter into binding agreements
- All information you provide is accurate and complete
- You have authority to enter into this agreement on behalf of your employer if applicable
3. Service Description
silvantada provides corporate accommodation rental services throughout Malaysia, including:
- Island-Proximity Apartments in coastal locations
- Sky Tower Apartments in urban business districts
- Peninsula Oceanfront Estates for executive accommodations
Our services include property selection assistance, lease arrangement, move-in coordination, and ongoing support during tenancy. Specific inclusions vary by property tier and are outlined in individual rental agreements.
Property availability is subject to change. We make reasonable efforts to maintain accurate information but cannot guarantee availability until a lease agreement is signed.
4. Rental Process and Agreements
4.1 Inquiry and Selection
Tenants may submit accommodation inquiries through our website or by contacting our team directly. We will present suitable property options based on stated requirements and discuss availability, pricing, and lease terms.
4.2 Application and Documentation
Selected tenants must provide:
- Valid identification (passport or Malaysian IC)
- Employment verification or corporate authorization letter
- Emergency contact information
- Payment details for security deposit and rent
4.3 Lease Agreement
Each rental is governed by a written lease agreement specifying rental period, monthly rate, included services, tenant responsibilities, and termination conditions. The lease agreement incorporates these Terms and Conditions by reference.
4.4 Security Deposit
Tenants must pay a security deposit equivalent to one month's rent before move-in. This deposit is held against property damage, unpaid utilities, or breach of lease terms. The deposit will be refunded within 30 days of tenancy end, minus any deductions for damages or outstanding charges.
5. Payment Terms
5.1 Rental Fees
Monthly rental fees are due on the first day of each rental period. Payments must be made via bank transfer to the account specified in the lease agreement. Late payments may incur administrative fees and penalties as outlined in the lease.
5.2 Included Services
Monthly rental rates include:
- Furnished accommodation
- Utilities (electricity, water, internet)
- Standard maintenance services
- Property-specific amenities as stated in lease
5.3 Additional Charges
Tenants are responsible for charges related to:
- Excessive utility usage beyond normal residential consumption
- Property damage beyond normal wear and tear
- Special cleaning or repair services requested by tenant
- Replacement of lost keys or access cards
5.4 Currency
All fees are quoted and payable in Malaysian Ringgit (RM) unless otherwise specified in the lease agreement.
6. Tenant Responsibilities
Tenants agree to:
- Use the property solely for residential accommodation purposes
- Maintain the property in clean and good condition
- Report maintenance issues and property damage promptly
- Comply with building rules, condo bylaws, and community regulations
- Not sublease or allow unauthorized occupants without written permission
- Respect neighbors and avoid disturbances or nuisances
- Allow access for inspections and maintenance with reasonable notice
- Secure the property and report security concerns
- Vacate the property in clean condition at tenancy end
Prohibited activities include:
- Illegal activities or anything violating Malaysian law
- Smoking in non-designated areas where prohibited
- Keeping pets without prior written authorization
- Making structural alterations or significant modifications
- Operating businesses from the property without permission
- Hosting large events or parties that disturb neighbors
7. Our Responsibilities
silvantada commits to:
- Provide properties in habitable condition at move-in
- Ensure essential systems (plumbing, electricity, HVAC) are functional
- Respond to maintenance requests within reasonable timeframes
- Coordinate repairs using qualified service providers
- Protect tenant privacy and personal information per our Privacy Policy
- Provide support and assistance as specified in the lease agreement
- Maintain compliance with Malaysian property regulations
8. Maintenance and Repairs
8.1 Standard Maintenance
We handle routine maintenance and repairs necessary to keep properties in good working order. This includes HVAC servicing, plumbing repairs, electrical issues, and appliance malfunctions not caused by tenant misuse.
8.2 Emergency Repairs
For urgent issues affecting safety or habitability (major leaks, electrical hazards, security breaches), tenants should contact us immediately. Emergency protocols and contact numbers are provided in lease documentation.
8.3 Tenant-Caused Damage
Repairs needed due to tenant negligence, misuse, or intentional damage are the tenant's financial responsibility. Costs will be deducted from the security deposit or billed separately.
9. Termination
9.1 Standard Termination
Leases terminate on the end date specified in the agreement. Tenants wishing to extend should notify us at least 30 days before expiration to discuss renewal options.
9.2 Early Termination by Tenant
Tenants may request early termination subject to lease provisions. This typically requires 60 days written notice and may involve termination fees or forfeiture of deposit depending on remaining lease duration and circumstances.
9.3 Termination by silvantada
We may terminate a lease immediately for:
- Non-payment of rent for more than 14 days past due
- Material breach of lease terms or these conditions
- Illegal activities on the property
- Serious damage to property or safety violations
- Providing false information during application
9.4 Move-Out Procedures
Upon termination, tenants must vacate the property, remove all belongings, return keys and access cards, and leave the property in clean condition. A final inspection will determine any deductions from the security deposit.
10. Limitation of Liability
Our services are provided on an "as is" basis. While we maintain properties diligently, we cannot guarantee uninterrupted service or that properties will meet all tenant expectations.
To the fullest extent permitted by Malaysian law:
- We are not liable for indirect, consequential, or punitive damages
- Our total liability is limited to amounts paid by the tenant in the preceding three months
- We are not responsible for tenant's personal property loss, theft, or damage
- We are not liable for third-party actions (building management, service providers, neighbors)
- Force majeure events excuse performance of obligations
Tenants are strongly advised to obtain renters insurance covering personal property and liability.
11. Indemnification
Tenants agree to indemnify and hold harmless silvantada, its owners, employees, and service providers from claims, damages, or expenses arising from:
- Tenant's use or misuse of the property
- Breach of lease terms or these conditions
- Tenant's violations of laws or regulations
- Damage to property or injury to persons caused by tenant
- Disputes with other tenants or building residents
12. Dispute Resolution
12.1 Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any disputes will be subject to the exclusive jurisdiction of Malaysian courts.
12.2 Informal Resolution
Before initiating formal proceedings, parties agree to attempt good-faith informal resolution through direct communication and negotiation.
12.3 Mediation
If informal resolution fails, parties may agree to mediation through a mutually acceptable mediator in Kuala Lumpur before pursuing litigation.
13. General Provisions
13.1 Entire Agreement
These Terms and Conditions, together with the lease agreement and any written amendments, constitute the entire agreement between parties. Oral representations or prior negotiations are superseded.
13.2 Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full effect. Invalid provisions will be modified to achieve their intended purpose to the extent possible.
13.3 Waiver
Our failure to enforce any provision does not constitute a waiver of future enforcement. All waivers must be in writing.
13.4 Assignment
Tenants may not assign or transfer their lease without our written consent. We may assign our rights and obligations to successors or affiliated entities.
13.5 Notices
Official notices must be sent in writing to the addresses specified in the lease agreement or to [email protected].
14. Changes to Terms
We may update these Terms and Conditions periodically. Changes will be communicated through:
- Updated posting on our website with revised date
- Email notification to active tenants for material changes
- Notice period of at least 30 days before changes take effect
Continued use of services after the effective date constitutes acceptance of updated terms. Active lease agreements remain subject to terms in effect at signing unless both parties agree to amendments.
